Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules for using the FreshCut NYC platform (the "Service"). It applies to everyone who uses the Service — customers, store partners, and delivery workers — and is part of our Terms of Service and the applicable partner or driver agreement. Breaking these rules can lead to the actions described in section 6.
1. General rules for everyone
You agree that you will not:
- Use the Service for any unlawful purpose or to violate any local, state, or federal law or regulation.
- Provide false, misleading, or stolen identity, payment, address, or licensing information.
- Impersonate another person or business, or misrepresent your affiliation with any person or business.
- Access or use another user's account, or share your credentials with anyone who is not authorized to act for you.
- Harass, threaten, defame, discriminate against, or endanger any customer, store partner, delivery worker, or FreshCut staff member.
- Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, its infrastructure, or other users' accounts or data.
- Probe, scan, or test the vulnerability of the Service except as expressly permitted by our Security Policy and its vulnerability-disclosure program.
- Scrape, crawl, harvest, or use bots or automated means to access the Service or collect data from it, except through our documented public API under its terms.
- Upload or transmit malware, or content that is obscene, hateful, or that infringes another's intellectual-property or privacy rights.
- Circumvent, disable, or defeat any security, rate-limiting, age-verification, or access-control feature.
2. Age-restricted products
Some vendors sell age-restricted products (for example cannabis, tobacco, or vape products) that require the buyer to be 21 or older. You must not attempt to purchase these products for anyone under the legal age, provide false identification, use another person's identity, or otherwise defeat the age-gate, ID-verification, or delivery-time ID inspection. Delivery workers must refuse handoff to anyone who cannot present valid identification or who appears intoxicated, and must record the refusal as required.
3. Customers
- Do not place orders you do not intend to pay for, or use payment methods you are not authorized to use.
- Do not abuse refunds, promotions, gift cards, referral credits, or the weight-reconciliation process (for example, by falsely claiming non-delivery or damage).
- Do not file fraudulent chargebacks. Contact support@freshcut.nyc to resolve an issue before disputing a charge with your bank.
- Submit only genuine reviews based on real orders. Do not post fake, incentivized, or retaliatory reviews, or content that is defamatory or that reveals another person's private information.
- Treat delivery workers with respect and provide safe, lawful access for delivery.
4. Store partners (vendors)
- Hold and keep current all required licenses, permits, and inspections (NYC Department of Health, USDA, and any product-specific licensing such as cannabis or tobacco retail).
- List only products you are legally authorized to sell, with accurate descriptions, pricing, weights, allergen information, and certification claims (halal, kosher, organic, etc.).
- Do not misrepresent certifications, sourcing, or product condition, and do not sell recalled, adulterated, expired, or counterfeit goods.
- Comply with the DCWP fee-cap, disclosure, and record-keeping obligations reflected in your Store Agreement, and do not attempt to pass prohibited fees to customers or workers.
- Do not divert customers off-platform to evade platform obligations, and do not manipulate reviews, rankings, or advertising metrics.
5. Delivery workers (drivers)
- Complete required onboarding, background check, and cold-chain training, and keep any vehicle or e-bike safety certifications current before going online.
- Maintain the cold chain, handle food safely, and record temperature checks honestly. Do not submit fabricated or simulated readings as compliance data.
- Verify identification for age-restricted deliveries and refuse non-compliant handoffs.
- Use in-app location and masked-calling features only to complete assigned deliveries; do not contact, track, or retain customer information for any other purpose.
- Do not manipulate earnings, location, delivery-completion, or minimum-pay records.
6. Reporting & enforcement
Report suspected violations to trust@freshcut.nyc (report a security vulnerability instead to security@freshcut.nyc). Depending on the severity and pattern of a violation, and to the extent permitted by law and your agreement with us, we may: issue a warning; remove content or listings; limit features; withhold or reverse payouts, credits, or promotions tied to abuse; suspend or permanently terminate an account; and report conduct to law enforcement or regulators. Every enforcement action is recorded in our audit log. Where an account is suspended or terminated, active sessions are revoked. We will give notice where required by law or your agreement, except where doing so would risk safety, fraud, or an ongoing investigation.
7. Changes
We may update this AUP from time to time. Material changes will be communicated as described in the Terms of Service. Continued use of the Service after an update means you accept the revised AUP.
